Pacifitec/pacifitec.com (herein “Pacifitec”) are services which offer Apple® and Apple-compatible product support by providing information for You (clients herein “You/Your”) and You alone to choose to take or not take action on regarding Your Apple family of products and services. By using this site and services (including but not limited to appointments in-person or remote, information provided therein or online in the form of articles and the like, etc.) You automatically agree to these Terms and Policies whether you’ve read them or not. If You do not wish to agree to them, then you must cease using the site and its services and information immediately.

Pacifitec is entirely independent of and not sponsored in any way by Apple, Inc. in California. All referenced Apple hardware and software are registered trademarks of Apple Inc. Errors or omissions of copyright, registration, service mark, trademark or other IP are by no means intentional and should not be construed as intellectual theft or fraudulent practices. Please contact Pacifitec directly to address any legal concerns.

By using and/or paying for any Pacifitec service, You agree to indemnify and hold harmless in perpetuity Pacifitec, its assigns, employees, heirs, and agents against any and all claims for damages including but not limited to monetary compensation. Pacifitec is neither a legal or medical expert and You are strongly encouraged to consult Your own experts regarding Your rights and health before, during, and after using any service from Pacifitec or products of third parties including but not limited to Apple. You agree that any dispute will be addressed through arbitration in and according to the laws of the State of Hawaii.

Pacifitec guarantees all services for 30 days. User changes, operator error, automatic software updates, and independent hardware failures may void this guarantee.

The 24/7/365 policy offers available services at special price tiers throughout the day, week and year. Prices are subject to change at any time. You acknowledge that prices are not final until purchases are paid and completed.

Pacifitec under no circumstances suggests, implies, or otherwise promises that its services will prevent death, harm, dismemberment, mental disorders, financial loss, or any other damage, nor the opposite including remissions, financial gains, or any other benefit. You engage these services at Your own risk and are strongly encouraged to consult all relevant experts prior to deciding on actions taken by You or on Your behalf regarding Your Apple and Apple-related products and services. Ultimately, You agree and acknowledge You are solely responsible for all actions and decisions regarding Your tech.

Due to recent changes in the global health landscape and political climate, Pacifitec reserves the right at its sole discretion to, at any time, provide or not provide any service or credit for paid or contracted services citing safety, time, availability, governmental restrictions, acts of terror, or other circumstance beyond our control; please refer to the Health Policy below for additional information.

 

 

Privacy Policy

 

Pacifitec keeps all personal, identifying information private and confidential and secure with 2048-bit encryption.

Nothing submitted to Pacifitec.com via telephone, computer, or text will be shared, promoted, sold or otherwise exploited other than to communicate, improve or troubleshoot our services.  From time to time, Pacifitec may share or recommend You share anonymized data with third parties like Apple Inc. either on Your behalf or via Your secured permission from Your authorized devices. Please note third parties have their own privacy policies about which Pacifitec has no knowledge or control and reminds you to familiarize yourself with such policies prior to accepting them.

You may opt out of mailing lists, text announcements and other communications at any time.

Pacifitec's data storage is not HIPAA compliant.

Pacifitec cooperates with authorities on all valid legal and security concerns.

 

 

Purchase Policy

 

All pre-paid Hours, Rates, Contracts, and Time purchased are valid for 30 days unless otherwise noted. After day 30, all paid purchases expire if unused.

Refunds are not offered on any pre-paid or post-paid Hours, Rates, Contracts and Time. Refunds may be available within 14 days of paid purchases for third-party products purchased on Your behalf via Pacifitec. After day 14, all paid purchases from any party are unavailable for refund via Pacifitec for any reason.

Paid purchases may be transferred with permission of Pacifitec after 14 days and before 30 days. Transferred purchases expire 30 days from original purchase date.

Hawaii General Excise Tax (GET) of 4.712% is applied to all purchases.

Health Policy


COVID + Other Airborne Pathogens

Pacifitec requests You and all members of Your household or business to wear a properly fitted N95 or better during in-person support regardless of vaccination or booster status against COVID and other airborne pathogens as well as distance properly. Pacifitec reserves the right to wear N95 or better respirators, as well as bring, temporarily install, and operate portable and removable HEPA filters for Your in-person appointments; additionally, You agree to not interfere with Pacifitec’s safety protocols.

Clients who fail to provide proof of vaccination and boosting, do not wear masks, and do not keep safe distance during in-person visits may be denied service immediately until remedied and may immediately forfeit any paid rates without refund. Appointments may be re-booked for future in-person support with new payment when You agree to comply with Pacifitec’s COVID protocols.

If You or anyone in Your household or business has any symptoms of or tests positive for COVID within the 14 days before Your in-person support appointment, You are required to inform Pacifitec prior to arrival. Failure to inform will result in immediate cancellation of Your appointment without refund or rebooking. If through Your intentional or unintentional failure to inform Pacifitec about Your accurate status You infect anyone from Pacifitec with COVID, You agree to be held responsible for any and all charges, costs, fees, and other payments in perpetuity to coordinate the full recovery of Your Pacifitec support specialist. You are required to inform Pacifitec of any symptoms or positive COVID tests results that occur up to 14 days after Your in-person appointments.

ALL PACIFITEC SUPPORT SPECIALISTS ARE VACCINATED AND BOOSTED AGAINST COVID, AND WILL WEAR N95 MASKS OR EQUIVALENT TO ALL IN-PERSON MEETINGS WHERE REQUIRED BY LAW. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS PACIFITEC FROM ANY REAL OR PERCEIVED COVID CLAIMS IN PERPETUITY REGARDING YOUR HEALTH. PACIFITEC SUPPORT SPECIALISTS WILL NEVER ATTEND IN-PERSON MEETINGS WITHIN 14 DAYS OF COVID SYMPTOMS, VERIFIED EXPOSURE, OR POSITIVE TEST.


Other

Due to the current global health situation and forecast regarding infectious diseases and other contagions, Pacifitec respectfully requests you inform Your in-person specialist of any recent exposures, symptoms, or positive tests for influenza, pox, colds, etc. What may seem minor could, in fact, be more serious, and Pacifitec always errs on the side of caution regarding You and Your health as well as the health of all specialists.

 

These Terms and Policies were created in good faith, are subject to change at any time, intended to be comprehensive but not exhaustive, and can be confirmed and explained by contacting Pacifitec support. Any errors or omissions are neither intentional nor should be construed as malpractice or fraud.
